Welcome to the terms and conditions ("Terms") for MudFire Inc. and Mudfire.com. These Terms are between you and MudFire Inc and/or its affiliates ("Mudfire.com" or "Us" or "we"). Wouldn’t it be awesome if there was more common sense and less lawsuits? How did we get here? Well here we are so here we go…
If you use our website or make a purchase on the website, you accept these terms, conditions, limitations and requirements. YOU AGREE TO READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS ONLINE SERVICE. Please note that your use of the Mudfire.com Web site is also governed by our Privacy Notice, as well as all other applicable terms, conditions, limitations and requirements. Your use of Mudfire.com signifies your agreement to the terms and conditions of use set forth below in the Agreement. If you do not agree to the terms and conditions set forth herein, please do not use this website.

You may not assign any of your rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of MudFire Inc. Any such purported assignment or delegation by you without the appropriate prior written consent of MudFire Inc. will be null and void and of no force or effect. We make the assignments around here kiddos.

All materials on Mudfire.com including without limitation text, images, software, audio and video clips are protected by copyright pursuant to U.S. copyright laws, international conventions, and other copyright laws. You agree to abide by all restrictions displayed herein or elsewhere on Mudfire.com
You may not download, display, reproduce, create derivative works from, transmit, sell distribute, or in any way exploit Mudfire.com or any portion thereof for any public or commercial use without the express written permission of MudFire Inc. and, if applicable, the Artist.

Only one of each artwork available: MudFire Gallery prides itself on offering one-of-a-kind, hand-made items. Unless otherwise specified, there is only one of each item available for sale. Our on-line store displays multiple images of each specific item available for sale. We do our best to accurately present each item through photography, descriptions and measurements. Please be aware that computer monitors may render colors slightly differently than how they appear in life.
Your shopping cart: Since there is only one of each item available, pieces are not sold until they are paid for, and until your order has been reviewed, processed, and confirmed by a human being. Usually an Erik or a Luba. Hi. Because we operate a physical store as well as the website, and because there are many imperfect computers in the chain of ether between you and MudFire’s physical showroom, occasionally the website will sell you an item that has extremely recently been sold to someone else. Thus adding an item to your cart and completing checkout does not guarantee a purchase. If the website allows you to purchase an unavailable item we will of course issue a full refund and send you some candy. The longer you leave items in your cart before checking out the more the chances grow of this type of occurrence.
Payment information: Payment for on-line purchases may be made by credit card or though your PayPal account. Orders shipping to Georgia are subject to sales tax. Your credit card is charged at the time the order is placed.
Will-Call/Pick-Up: You may purchase an item on-line and request that we hold it for pickup. To do so, please select the "pick up" option in the shipping options section. Shipping charges will not apply. All pick-up orders are subject to sales tax.
Shipping of Artwork
If you have any special shipping needs, please let us know. We are less flexible than 14 year old gymnasts, but for our beloved customers, we are as flexible as we can be.
How We Ship: Method of shipping depends on your order's weight, where it's going, and how fast you need it. Generally, for U.S. destinations we ship by UPS and the U.S. Postal Service. If you have special shipper needs, please let us know.
When We Ship: Items that are part of a current exhibit are shipped within 5 business days of the conclusion of the exhibit. The last date of the exhibit is clearly indicated on the exhibit page. We do understand that there are times when you may need special service. If you have a deadline, such as a wedding or other time-sensitive gift-giving requirement, please tell us preferably by giving us a call. We will do our best to accommodate your needs. Items that are not part of an exhibit, are shipped within 5 business days of your order.
Packing Materials: Whenever possible we use upcycled and/or previously used packaging materials. All upcycled/previously used packaging materials (peanuts, bubble wrap, boxes) are clean and completely serviceable, however, they may contain markings or other signs of use. If the item you are purchasing is a gift or you specifically do not wish to receive upcycled packaging materials, please let us know in the comments section at checkout. If you are in the Atlanta metro area and have packing material you’d like to recycle, please consider your local potters.
Shipping Charges: The shipping charge for each item is included in the item description. This charge includes careful packing, packing materials, insurance and 3rd party shipping costs for this item only. If you are purchasing a single item, this will be your total shipping charge. You will receive a confirmation email at the time of shipment. If you are purchasing more than one item in the same order, at the time of your checkout you will be charged the combined shipping charges for all items. However, when we pack your items we may be able to offer you a partial refund on shipping costs. If you qualify for a partial refund on shipping costs the human processing your order will issue the refund and send you a note confirming such.
International Orders: Orders placed through MudFire.com ship only to customers in the United States and Canada. If you live outside these two fair nation states, please contact us for order inquiries and we’ll do our best to accommodate you.
Shipping to Alaska and Hawaii: Our standard shipping charges are for the continental US only. Since all purchases shipping to Alaska and Hawaii must go via air service, additional shipping charges may be required. After you place your order, we will calculate shipping, and will contact you if any additional charges are required.

Warranties and Product Warnings
MUDFIRE MAKES NO REPRESENTATIONS REGARDING FOOD SAFETY, MICROWAVE, OVEN, DISHWASHER SAFETY, OUTDOOR USE, FREEZER SAFETY. WE SELL DECORATIVE SCULPTURE, LOWFIRE EARTHENWARE PRODUCTS, ALTERNATIVE FIRING METHOD STUFF, IN ADDITION TO FULLY FUNCTIONAL AND FOOD SAFE DISHWARE. IF YOU HAVE QUESTIONS REGARDING A SPECIFIC ARTWORK, PLEASE DISCUSS WITH A SALES ASSOCIATE. WE DO NOT SCIENTIFICALLY TEST FOR FOOD SAFETY BUT RELY ON THE DILIGENCE OF THE MAKER.
In general, handmade clay objects should be handled with care and handwashed when possible. Harsh dishwasher detergents may, over time, harm the surface of some pottery. For items decorated with image transfers, decals or lusters, we recommend handwashing.. Items decorated with metallic lusters should never be used in microwave ovens. Ceramic vessels should never be put on a stovetop or used on top of flame. When using items meant for oven-use, handmade vessels should always be heated with the oven and never placed in an already hot oven. Clay objects should not be subjected to freezing. Unless specifically indicated, clay objects should not be left outside where they may be subjected to frost. Breakage may occur.
Under certain circumstances, the materials used in clay may be harmful to humans or animals, particularly if used in ways other than those intended by the artist. For example, decorative objects such as "raku-fired" vessels should not be used for eating and/or drinking; they are only for display and viewing pleasure.
MudFire Inc. makes no warranties whatsoever in regard to the artwork, nor do we prepare or provide product information beyond the common-sense items listed in this paragraph.
You may return most artwork within 14 days of receiving the work for a refund of the artwork cost if for any reason you are not satisfied. The original shipping charges are never refundable. We cannot accept returns on special orders and custom orders. If you wish to make a return, please email us at email@example.com or call us at 404-377-8033 for assistance. Returns received without prior authorization may not be refundable.
Returning an item: Repack the product in its original packaging materials. If the product is damaged in return transit you will be responsible. Please insure the return package with your shipper for the full purchase price. You are responsible for return shipping costs.
If you are returning a product because it was defective or we shipped you an item that you did not order, MudFire will pay the return-shipping costs. You must notify us of any shipping errors within 48 hours.
IF WE RECEIVE A RETURN SHIPMENT THAT IS DAMAGED WE WILL NOT ISSUE A REFUND, YOU WILL NEED TO TAKE IT UP WITH THE SHIPPER AND RECEIVE INSURANCE FUNDS FROM THE SHIPPER.
Refunds: You can expect a refund in the same form of payment originally used for purchase within 7 to 14 business days of us receiving your return, providing it arrives safely. You will be credited for the price of the artwork and any sales tax. The original shipping charges are not refundable. We cannot accept items that have been damaged, altered, or visibly used. Artwork Damaged in Transit: If your package appears damaged, please call us immediately at 404-377-8033 so we can take appropriate action for any insurance claim. You must retain all of the original packing materials and will generally need to cooperate with the shipper’s return policies.
Workshop Ticket Purchases
Workshop fees include a non-refundable ticketing charge equal to 25% of the total fee paid. Stated workshop fees also include all materials charges, lab fees, etc. The listed fee is the total all-inclusive fee. Only 75% of the fee is ever refundable.
Because of our obligations to our instructors, no refund of any payment will be made for withdrawals made within 30 days of the start of the workshop. Prior to the 30 day limit, if you wish to withdraw from a workshop for which you have paid, we will refund 75% of the total fee. The 25% ticket charge is never refundable.
Workshop tickets are fully transferrable. If you wish to transfer your ticket to someone else, please feel free to handle that in whatever manner you like. Please notify us of the transfer so that we can accommodate the transferee at the workshop and stay in touch with them with appropriate information. The individual to whom you have transferred your ticket is bound by the same withdrawal and refund policies as the original purchaser.
If it is necessary for MudFire to cancel a class for any reason, students will be notified and offered the option of another class or a full refund. We cannot be responsible for nonrefundable airline tickets or other travel expenses incurred for a cancelled workshop.
